This website and the Rhythm & Sails Trips are operated by Rhythm & Sails, LLC (“Rhythm & Sails,” “we,” “our” or “us”), 7106 S Brook Forest Road, Evergreen, CO 80439, USA. This Privacy Policy explains what personal information we collect, how we use and share it, and the choices you have. It applies to rhythmandsails.com, our emails and social media pages, and your Booking and Trip. It is part of, and should be read together with, our Terms and Conditions.

2.0 Information We Collect

Information you give us. Depending on how you interact with us, this may include:

Inquiries and sign-ups: your name, email address, phone number, and any message you send us.

Bookings: the names and contact details of everyone on a Booking, billing address, payment plan selection, and boat or cabin preferences. Payments are made through our payment processor, WeTravel. Rhythm & Sails never receives or stores your full card number or bank account details.
Crew List information: as required by port authorities in St. Vincent and the Grenadines, your full name, residence, date of birth, place of birth, email, phone number, passport number and nationality.
Travel insurance: your insurance provider, policy number and emergency assistance phone number.
Health, accessibility and trip details: medical conditions or disabilities you choose to disclose so we can keep you safe and make reasonable accommodations, along with dietary needs, emergency contacts and similar details that help us plan your Trip.
Communications: emails, messages, survey responses and feedback you send us.

Information collected automatically. When you visit our website or open our emails, we and our service providers use cookies, pixels and similar technologies to collect information such as your IP address, browser and device type, pages visited, referring website, campaign links (UTM parameters) you clicked, and whether you opened or clicked an email. We use Google Analytics, Google Tag Manager and the Meta pixel for this purpose.

Photos and video. Our photographers and videographers capture photos, video and audio during Trips, which may include you. See Section 8.

3.0 How We Use Your Information

To respond to inquiries, manage your Booking and deliver your Trip, including boat and cabin placement, meals and activities.
To process payments and refunds through WeTravel.
To submit Crew Lists and meet the entry, port and customs requirements of St. Vincent and the Grenadines.
To keep guests, crew and vessels safe, including handling medical situations and emergencies.
To confirm you meet our requirements, such as minimum age and mandatory travel insurance.
To send you emails about upcoming Trips, waitlists and news. You can unsubscribe at any time.
To understand how people find and use our website and to measure and improve our marketing, including advertising on Google and Meta platforms.
To comply with the law, enforce our Terms and Conditions, and protect our rights and the rights of others.

We use health and accessibility information only to plan your Trip and keep you safe. We never use it for marketing.

4.0 How We Share Your Information

Service providers that help us run our business, under agreements that limit how they can use your information. These include WeTravel (bookings and payments), Webflow (website), Mailchimp (email), Google (analytics, email and file storage), Zapier (connecting our systems) and Meta (social media and advertising measurement).
Trip partners who need certain details to deliver your Trip, such as our charter company, captains and crew, local restaurants and activity providers.
Government and port authorities in St. Vincent and the Grenadines and other countries visited during a Trip, which receive Crew List information as a condition of entry.
Emergency and medical providers, and your insurer, if needed to respond to an emergency or support a claim.
Legal and safety: when required by law, subpoena or court order, or when we believe disclosure is needed to protect the safety of any person or to enforce our Terms.
Business transfers: if Rhythm & Sails is involved in a merger, acquisition or sale of assets, your information may be transferred as part of that transaction.

WeTravel processes your payment information under its own privacy policy, which we encourage you to review.

5.0 Cookies, Analytics and Advertising

We use cookies and similar technologies to operate our website, remember your preferences, understand site traffic and measure our marketing. Google Analytics helps us understand how visitors use our website, and the Meta pixel helps us measure and improve our advertising on Facebook and Instagram.You can control cookies through your browser settings and delete them at any time. You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on, and manage ad preferences through your Google and Meta account settings.

6.0 International Travel and Data Transfers

Rhythm & Sails is based in the United States, and our service providers primarily store data in the United States. Because our Trips take place in St. Vincent and the Grenadines, some of your information, including Crew List information, will be transferred to and used in that country, where data protection laws may differ from those where you live. By booking a Trip, you understand that your information will be transferred for these purposes.

7.0 How Long We Keep Your Information

We keep personal information only as long as we need it for the purposes described in this policy, including legal, tax and accounting requirements. As a general guide:

Crew List, passport and health information: deleted within 12 months after your Trip ends, unless we need it longer for a claim or legal requirement.
Booking and payment records: kept for 7 years for tax and accounting purposes.
Email marketing lists: kept until you unsubscribe or ask us to delete your information.
Photos and video: may be kept and used as described in Section 8.

8.0 Photos and Video

Photos, video and audio captured during Trips may be used on our website, social media, emails and advertising. If you do not want to be featured in our marketing, email info@rhythmandsails.com before your Trip begins. If you appear in content we have already published and would like it removed, contact us and we will make reasonable efforts to remove it from channels we control.

9.0 How We Protect Your Information

We use reasonable administrative, technical and physical safeguards to protect your information, including limiting access to sensitive information such as passport and health details to the people who need it to run your Trip. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

10.0 Your Choices and Rights

Marketing emails: click “unsubscribe” in any email, or email us. We will still send you important messages about your Booking.
Access, correction and deletion: you may ask to see, correct or delete the personal information we hold about you by emailing info@rhythmandsails.com. We may need to verify your identity, and we may keep information we are required to retain by law or need for an active Booking.
State privacy rights: depending on where you live, you may have additional rights under state privacy laws. We will honor requests as required by applicable law and respond within 45 days.

11.0 Age Requirement

Our Trips are for guests 21 and older, and our website is not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe a minor has given us personal information, contact us and we will delete it.

12.0 Links to Other Websites

Our website and emails may link to websites we do not control, including WeTravel, our partners and artists. Their privacy practices are governed by their own policies.

13.0 Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated version on this page with a new effective date, and if we make material changes, we will notify Lead Bookers with active Bookings by email.
